Confidentiality of Substance Use Disorder Records (42 C.F.R. Part 2)

Grand Rising Behavioral Health provides substance use disorder (SUD) treatment. Records that would identify you as having or having had a substance use disorder are protected under federal law (42 U.S.C. § 290dd-2) and its regulations (42 C.F.R. Part 2). Generally, we may not tell a person outside our program that you attend the program, or disclose any information identifying you as having a substance use disorder, unless:

You consent in writing
The disclosure is permitted by a court order
The disclosure is made to medical personnel in a genuine medical emergency
The disclosure is made to qualified personnel for audit, evaluation, or research purposes

Records disclosed with your written consent must be accompanied by a statement prohibiting redisclosure except as permitted by 42 C.F.R. Part 2. Federal law does not protect information about a crime committed by a patient at the program or against program personnel, or reports of suspected child abuse or neglect made under state law.

Violation of these federal laws and regulations by a program is a violation of federal law. Suspected violations may be reported to the U.S. Department of Health and Human Services, Office for Civil Rights at hhs.gov/ocr/complaints.

Telehealth & Telemedicine Services

This Notice applies equally to services delivered in person and via telehealth or telemedicine. Telehealth sessions are conducted through an encrypted, HIPAA-compliant platform, are not recorded without your written consent, and are provided only to patients located in Massachusetts, the only state in which our clinicians are licensed to provide telehealth services.

Changes to This Notice

We may update this Notice at any time. Any revised Notice will apply to all protected health information we maintain, will be posted on this page with a new effective date, and is available in paper form upon request.
